Here is the letter that I sent to Gary Weeks Director of the Department of Human Services (DHS) on 5-25-04 the day after we picketed the OVRS office and the day before I was arrested:
This letter is to Gary Weeks Director of the Department of Human Services.
Dear Gary
I just got off the phone to Chet Houser from the Governors Advocacy Center and he told me that you should be apprised of the situation in both the Branch Offices of DHS and OVRS. There is a DHS Special Investigator here in Douglas County working on another case. His name is Michael Tryon I believe. I would like to talk to him or another DHS Special Investigator about actions taken by DHS Branch Manager Peggy Kinnerly, OVRS Branch Manager Amy Kincaid and the cover-up that is taking place here in Douglas County. I have certain disabilities that make it easiest for me to conduct business via personal interview or email. I prefer email as communication media of choice. I would like every correspondence to be documented as the DHS staff that I have been in contact with to date lie and LOSE incriminating evidence when ever possible. I would like a recording or a transcript of any and all DHS, OVRS or other Government communications dealing with me in any manner. I know that this may at first seem to be a drastic measure for me to take. I feel confident that full documentation of all correspondence is necessary to insure that the cover-up persists no further. Ted Swigart has given a small portion of a series of emails to him and Amy Kincaid to the risk management team so as to manipulate them into going to the DOJ to stop me from going to the local OVRS office. Yesterday I went to picket the local office and found that an ARMED GUARD is now being posted at the door. I find this VERY offensive and demand that it be halted immediately.

here is my letter to Gary Weeks and our OVRS group site started on 5-28-04 the day I got out of jail.
I just woke up from a nap and it all seems to be just a dream, right now. I was arrested for Criminal Trespass II and Disorderly Conduct (I really did not have that much fun). It was because I went into the local OVRS (VRD) office to ask for a complaint form (Video was shot by one of the OVRS-Project's Advocates) so that I might be able to file a complaint against Amy Kincaid my OVRS (VRD) counselor and branch manager. One of our staff at Oregon Citizens Education and Access (OCEA) the OVRS-Project had a chat with a DHS Special Investigator about some of the problems we have been having here in Douglas County. He was alarmed that none of our complaints had made it to his office. I wished to see if a new complaint might make it. Well apparently Amy pushed the issue and forced the Roseburg Police Department (RPD) to arrest me two full days after our picketing. Not only that now the whole charge could go away if Amy Kincaid would drop the charges. I am now under a court order to not go onto the property of the local OVRS Office. I will start to transcribe all the conversations that I have taped with Amy Kincaid and Ted Swigart. as well as the taped Administrative Hearing when the record is closed and I can get tapes from the Fair Hearings Officer with in the next 15 or so days. I will also enter all of this on the web site above.
Let me start out by saying that I am outraged that a branch of the government that has a mandate of law to help those with disabilities by providing a significant investment in their vocational goals has the audacity to not provide adequately trained personnel to assist those applicants that are deemed eligible for services to those vocational goals. All of my words and actions to date are manifestations of my disabilities. Even this letter will show the signs of ADHD type III. Mr Weeks it would probably suit my purposes better if I were to have someone else write this letter, as I am told that I often insult those that I am asking to help me. If you feel this way please tell me and tell me why, it will help me to learn to communicate more effectively. As I am being prosecuted for a manifestation of type III ADHD, learning to overcome my disabilities is my real job in life as it is with everyone. I have found that DHS has taken fiscal control of OVRS, without assuming the expense of insuring proper training (could this be where the $1,500,000.00 in DHS budgetary surplus came from). Instead DHS has chosen to hire and promote incompetent individuals to deal with us that have significant bearers to employment (could it be possible that DHS has the wrong mindset for a employment program). I have yet to meet an employee of DHS that has demonstrated any knowledge of the simptamology of LD's or ADD/ADHD. We have had to endure being insulted and abused by undertrained staff that can only be described as "AFS burnouts". when I read the Rehabilitation Act of 1973 (especially section 504) I see that we with disabilities have a right to be protected from all governmental agencies and personnel that injure our esteem and self worth. I even get this from the DHS personnel manual. I believe that it states that insulting or degrading clients is grounds for immediate termination. I will be asking for the immediate termination of some of the people I will be describing below. Unless of course it is not covered up. which brings me back to the story at hand.
I will start with Mary Worthington. I really should thank her, for it was her abuse that led me to the revelation that most of the people that have ADD, ADHD, LD, OCD, ODD and many other cognitive, perceptual and mental disabilities are having their rights violated under the rehabilitation act of 1973 as well as civil and constitutional violations. Mary talks to her clients as thou we were liars and malingerers. saying that she is demeaning is being very generous. I have heard of cases other than mine, where she has acted with a condescending "mommy dearest" demeanor. She would schedule a meeting with no defined goals or objective. when I would protest she would dismiss my protests as trivial. Then she scheduled a community resource meeting with herself, my old TANF case manger Mark Shifferd, UCAN coordinator Jane Larsen, my advocate Betsy Cunningham, my wife Nikki Claunch and myself. for two weeks I asked Mary why we were having this meeting. I got vague answers and requests for me to gather trivial information. finally two or three days before the meeting Mary told me that she needed to have this meeting to see who was going to pay for the day care of my son Trey. she then told me that she could get DHS to pay through my old closed TANF claim. So I called Mark Shifferd to run this by him as to how we were going to get day care for my son paid for. Mark told me that my TANF claim had been closed. He would love to pay for day care but he could not. So I called Mary back to tell her this and she insisted that Mark did not know what he was talking about and she will make it happen. I bought this and waited until the meeting. I had brought a tape recorder with me as a reasonable accommodation to my disability (notes). We all were there except Mary. We started the meeting a little late but without Mary. I will state that one of Mary's (and now Amy's) concerns is whether I can get to work on time. I started my tape and asked Mark if there was any way that DHS/AFS/TANF could pay for day care for my son. He again reiterated that he would love to but could not. I then started to talk about my VRD plan and trying to see if Mark or Jane could help with that and neither could help me achieve my proposed employment goals. 15 minutes after the meeting started Mary comes strolling in. I enquirer as to her tardiness (reminding her how unprofessional her actions look). I then ask her to please tell me how she is going to make Mark pay for child care. she was displeased but had no retort. I then started to criticize Mary about her unprofessional actions and attitude to which she got up out of her chair and stated loudly "with an attitude like that it is no wonder you can't keep a job". Then she slammed her chair against the table and walked out. well the meeting was of course ended at that point. I shut off my tape recorder. at this time I would like to request the immediate termination of OVRS Case Manger Mary Worthingtom. For cause.
My advocate, my wife and myself all filed formal complaints with VRD and Peggy Kinnerly Branch Manager of the Douglas County Office of DHS. Betsy (my advocate) and myself attended a meeting with Joseph Miller and Amy Kincaid. We gave both written and verbal accounts of Mary's actions. at the conclusion of the meeting Joe asked to borrow the tape of the meeting. I handed the tape to Joe and told him that I would be needing it back and he agreed. as Amy Kincaid was just hired to the position of branch manager she was being trained by Joe and therefor invited to the meeting. Joe had less than one or two weeks left of training to do with Amy. I believe that Joe left the action against Mary to be dealt with by Amy. by the way my tape was lost and no one knows what happened to it. Mr Weeks I will now ask for a formal investigation into the dispensation of my property. I will not go into all the things that need to be explored but instead be as brief as possible. as Peggy Kinnerly did not do her job and had to actively participate in the cover-up I am now asking for her to be terminated as well.
Now I will jump to this February when the Rehabilitation council had its meeting here in Roseburg. I showed up and waited until the time for public comments. I then took that time to tell the whole story to the council. I do know that Ted Swigart was present at this meeting and when I voiced my accounts of my treatment by OVRS staff. I informed the council that I would be going back for services and would keep them apprised via email as to my outcome. I then went to apply for services as I stated I would. I was assigned Branch Manger Amy Kincaid as my case manager. I was directly making statements as to the incompetent actions of Amy Kincaid. As I stated before Ted Swigart was at the meeting, in the capacity of inrim Director of OVRS. Ted should have investigated this or asked you Mr Weeks for advice as to how to investigate not just mine but the two other complainants that were at that meeting of the council about Amy Kincaid. I will now ask for Mr Ted Swigart's immediate termination for dereliction of duty and other offenses that will become evident upon further investigation. I have on tape Ted admitting that he and Amy had a conversation as to who would take my case at the local office and he admits to being one of the ones that made the decision for Amy to be assigned my case. I don't think that anyone that was involved with the decision for Amy to take my case had my best interests in mind. I will now refer you to Section 504 of the Rehabilitation Act of 1973. But Ted and Amy did not stop there, not at all. The very first requests by Amy, upon my first visit was a psych-eval and a work assessment. Neither of which would seem unreasonable for someone without my extensively documented diagnosis of ADHD/LD and my extensive work history in direct sales/marketing, telemarketing and advertising. Which would make one wander as to why the psych-eval and ask the questions what would be the appropriate venue for the work assessment and what are we trying to assess. I view these demands as retaliatory for my comments at the council meeting. I believe Ted was involved in all the decisions that Amy made in my case. As I included Ted in all my correspondences with OVRS I can see no way that he is not copable for all actions taken by Amy Kincaid. But wait Ted made the decision that finally got me arrested. Didn't he.
>From day one of my return I will admit that I have made demands. Demands like I want my tape back. I want my plan for my employment goals to be acknowledged. I want my voice to be heard this time. So I CC'ed all my emails to (guess who) Ted Swigart interim director of OVRS. Now I would have thought that he would have done some kind of investigation. At least that is what I was trying to get started so that I could get the services that I am entitled to. But Ted is far to incompetent to do as I am expecting you to do Mr Weeks. He instead chose to escalate tensions by keeping Amy as my case manager. Once again no one was interested in seeing me achieve my vocational goals. as a matter of fact Ted sent a Mr Westwood from the Portland Office of OVRS to try and get me to agree to their demands on me, but to also inform me that they have upgraded their demand of psych-eval to nueropsych-eval. Now this is all because of me complaining about my treatment by OVRS staff. After not having my complaints addressed I began to try to tell Ted and Amy what history has shown the reason our government answers the questions that they are asked. I talked about how we should have listened to the people of Afghanistan and only given the assistance that they wanted. I believe that we would not be in this world terror situation had we not sought our own agenda. Acknowledgment of the sovereign rights of a people or person should be the only business of our government. but I digress. This email was to show that people will seek to do damage to you if you do not listen too and address their grievances. My advocate and I had already tried to talk to them about "due process" and that got us nowhere. Well in my Fair Hearing Mr Westwood was asked about my emails and actions. My advocate went down the list of my actions and asked him point by point. Mr Westwood agreed that everything in my emails and every action I have taken has been consistent with my current diagnosis. So everything that has happened is attributed to my disabilities. That would mean that the current level of training of the OVRS staff and Mr Swigart have, has without a doubt been aggravative to my disability. I have a recording of Ted telling me that he sent only the one email to the risk management department. which then sought to limit my accessibility to the local office (not any personnel just the location). which gave Ted the back up to send the letter, that gave Amy the back up to have me arrested for asking (remember the video) for a complaint form so that I could complain or lodge a grievance against Amy Kincaid. You will not have to terminate Amy's employment as I will see to her arrest as she saw to mine. Amy Kincaid has lied about and slandered my advocate so as to cause her a job at Umpqua Valley Disabilities Network. So don't get me wrong if you want to fire her I won't complain.
Mr Weeks I demand that you order Amy Kincaid to drop all charges against me before the seventh of June. The new director of OVRS will be at the local office. I wish to formally lodge a complaint against Ted, Amy and Mary. I wish to do this with a local reporter present so as to have all of this made public. I am currently under a provisional release from the Douglas county jail. that release is conditional upon me not going to 2020 Newcastle, the OVRS office in Roseburg. I have been given a court appointed attorney for I am poor. I can come to your office or any other office but this one. with the price of gas I would have to budget in the trip for any other contact to get the services I am entitled to. this is truly a travesty and I demand that you put and end to it. I believe that the only reason that my God gives me to get physically violent with anyone is to serve my country or protect my family. neither of which would be served by doing any physical harm to anyone at the local office much less the office it's self. I do wish to see and have told all that are addressed in this email fired and never allowed to serve the people again. That is the only harm I wish to see happen to these people. that is only to protect my fellow Oregonian from the corruption of self serving servants of the public interests.
